Terms of Service

1. Acceptance of Terms

By downloading, installing, or using AskWatch ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

AskWatch is an AI assistant application for Apple Watch, iPhone, Apple TV, and CarPlay that allows you to interact with various AI language model providers. The App offers two modes of operation:

BYOK Mode (Bring Your Own Key): You provide and manage your own API keys from third-party AI providers. Available with a one-time PRO purchase or free tier.

Managed AI Mode (Subscription): With an AskWatch+ or AskWatch Ultra subscription, we provide access to AI models through our managed service. No API keys required — we handle the AI infrastructure.

3. Third-Party Services

AskWatch integrates with third-party AI providers including but not limited to:

  • OpenAI
  • Anthropic
  • Google AI
  • Perplexity
  • xAI
  • Groq
  • Mistral
  • DeepSeek
  • OpenRouter
  • Cerebras
  • Cohere
  • Together AI
  • SiliconFlow

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for:

  • The content or accuracy of AI responses
  • Service availability or interruptions of third-party providers
  • Costs incurred from API usage
  • Changes to third-party pricing or terms

4. User Responsibilities

You agree to:

  • Provide and manage your own valid API keys
  • Comply with the terms of service of all third-party AI providers you use
  • Keep your API keys secure and confidential
  • Use the App in compliance with all applicable laws and regulations
  • Not use the App for any illegal, harmful, or abusive purposes
  • Not attempt to reverse engineer, modify, or distribute the App

5. API Key Security

While we store your API keys securely in Apple's iCloud Keychain with end-to-end encryption (synced across your devices):

  • You are responsible for the security of your API keys
  • Never share your API keys with others
  • Monitor your API usage and costs through your provider's dashboard
  • Revoke and replace keys if you suspect unauthorized access

Important: We are not liable for any charges, damages, or losses resulting from unauthorized use of your API keys.

6. Purchases and Subscriptions

One-Time Purchases (BYOK):

  • Free Version: Up to 2 AI providers, limited daily voice sessions, basic widgets
  • PRO Personal: One-time purchase for unlimited BYOK access to all app features
  • PRO Family: One-time purchase for up to 6 family members via Family Sharing

Auto-Renewable Subscriptions (Managed AI):

  • AskWatch+ (Plus): Access to fast AI models, unlimited voice chat, all PRO features included. Available as weekly, monthly, or yearly subscription.
  • AskWatch Ultra: All Plus features plus premium AI models, web search, higher daily limits, and extended conversation memory. Available as weekly, monthly, or yearly subscription.

Free Trial: New subscribers may be eligible for a free trial period. At the end of the trial, your subscription will automatically renew at the standard price unless cancelled at least 24 hours before the end of the trial period.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions in your Apple ID account settings.

Billing: All purchases and subscriptions are processed through the Apple App Store and are subject to Apple's terms. We do not collect or store any payment information. Refund requests must be directed to Apple.

7. Managed Proxy Service

When using Managed AI mode (subscription), your AI requests are routed through our managed proxy service for security and reliability. This service:

  • Routes your requests to AI providers on your behalf
  • Does not store, cache, or log the content of your queries or AI responses
  • Logs only anonymized metadata (device identifier, timestamp, status code) for security monitoring, automatically deleted after 7 days
  • Enforces daily usage limits based on your subscription tier
  • Uses device verification (Apple App Attest / DeviceCheck) to prevent unauthorized access

8. Usage Limits

Managed AI subscriptions include daily usage limits that vary by tier. Limits reset daily at 00:00 UTC. If you exceed your daily limit, you may continue using the app with your own API keys (BYOK mode). Web search queries have separate cost tracking applied against your subscription budget.

9. Device Verification

To ensure subscription security, AskWatch uses Apple's device verification technologies (App Attest on iOS/watchOS, DeviceCheck on tvOS). This binds your subscription to your device using a cryptographic token. Device identifiers are not correlated with your personal identity and exist solely for subscription security.

10. Data Retention

For subscription management, we store the following data on encrypted servers in the European Union:

  • Subscription transaction identifier (provided by Apple)
  • Subscription tier and status
  • Daily usage statistics (query counts, token usage)

We never store: the content of your queries, AI responses, conversation history, or any personal information beyond your subscription status. Subscription data is automatically deleted 30 days after cancellation.

11. Intellectual Property

The App, including its design, code, and content, is owned by mobilComm Ltd. and protected by copyright and other intellectual property laws.

AskWatch is not affiliated with, endorsed by, or sponsored by any of the AI providers. All third-party trademarks and service marks are the property of their respective owners.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of AI responses
  • Uninterrupted or error-free operation
  • Compatibility with all devices or system configurations

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • API charges or costs from third-party providers
  • Actions taken based on AI responses
  • Damages exceeding the amount paid for the App

14. Indemnification

You agree to indemnify and hold harmless mobilComm Ltd., its officers, directors, and employees from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit through the App

15. Termination

We reserve the right to terminate or suspend access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

16. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
